New USACE Guidance on Induced Flooding
The U.S. Army Corps of Engineers (USACE) recently released guidance regarding “Induced Flooding”. The guidance has the potential to significantly negatively impact the future of flood control. The guidance applies to all USACE districts and Field Operating Units and was issued in response to the Ideker Farms case.

Waters of the U.S. (WOTUS) Update
The U.S. Environmental Protection Agency (EPA) and U.S. Army Corps of Engineers (USACE/Corps) have released a supplemental proposal that could further narrow the definition of “waters of the United States” under the Clean Water Act. The supplemental notice has not yet been published in the Federal Register. Once it is published, a 30-day public comment period will begin.
“Waters of the United States” (WOTUS) is the term used to define which waters and wetlands are subject to federal jurisdiction under the Clean Water Act. That definition matters because it helps determine when federal Clean Water Act requirements apply, including permitting under Section 404 for the discharge of dredged or fill material, permitting under the National Pollutant Discharge Elimination system (NPDES), and other regulatory requirements tied to federally jurisdictional waters.

Midwest Flood Control Testifies to Congress on WRDA 2026
On December 17, 2025, Midwest Flood Control Association Executive-Vice President Charles Camillo testified before the U.S. House of Representatives Transportation and Infrastructure Committee’s Subcommittee on Water Resources and Environment for the hearing, “Water Resources Development Act of 2026: Stakeholder Priorities.” The subcommittee examined the different perspectives held by non-Federal partners and the challenges they face, and what they believe should be addressed in the Water Resources Development Act (WRDA) 2026 bill.
